In the meantime, artificial intelligence has emerged as a transformative agent that has the potential to transform traditional judicial processes. This article examines in depth the challenges and legal requirements arising from the integration of artificial intelligence into e-proceedings and dispute resolution. Using a descriptive-analytical research method and citing reliable international sources, key challenges such as legal liability and accountability, transparency and explainability, data privacy and security, algorithmic bias and discrimination, as well as challenges arising from automated decision-making are analyzed. In the following, the necessary legal requirements to address these challenges are presented, including the development of comprehensive regulatory frameworks, the establishment of technical and ethical standards, the design of independent oversight mechanisms, and the need for training and capacity building for judges and lawyers. This article concludes that despite the great potential of AI to increase efficiency and access to justice, realizing these benefits depends on anticipating and addressing upcoming legal challenges through smart regulation, responsible governance of technology, and upholding fundamental legal values ​​such as fairness, equality, and due process. با گسترش فناوری‌های دیجیتال، نظام‌های قضایی در سراسر جهان در حال گذار به سوی دادرسی الکترونیک و روش‌های جایگزین حل‌وفصل اختلافات (ADR) مبتنی بر فناوری هستند. در این میان، هوش مصنوعی به عنوان یک عامل تحول‌آفرین ظهور کرده است که قابلیت دگرگونی فرآیندهای سنتی دادگستری را دارد. این مقاله به بررسی عمیق چالش‌ها و الزامات حقوقی ناشی از ادغام هوش مصنوعی در نظام دادرسی الکترونیک و حل‌وفصل اختلافات می‌پردازد. با استفاده از روش تحقیق توصیفی-تحلیلی و با استناد به منابع معتبر بین‌المللی، چالش‌های کلیدی از جمله مسئولیت حقوقی و پاسخگویی، شفافیت و تبیین‌پذیری، حریم خصوصی و امنیت داده‌ها، جانبداری الگوریتمی و تبعیض، و همچنین چالش‌های ناشی از خودکارسازی تصمیم‌گیری مورد تجزیه و تحلیل قرار می‌گیرند. در ادامه، الزامات حقوقی ضروری برای مقابله با این چالش‌ها، شامل تدوین چارچوب‌های نظارتی جامع، ایجاد استانداردهای فنی و اخلاقی، طراحی سازوکارهای نظارتی مستقل، و ضرورت آموزش و ظرفیت‌سازی برای قضات و وکلا ارائه می‌شود. این مقاله نتیجه می‌گیرد که علی‌رغم پتانسیل بالای هوش مصنوعی برای افزایش کارایی و دسترسی به عدالت، تحقق این مزایا منوط به پیش‌بینی و رفع چالش‌های حقوقی پیش‌رو از طریق قانون‌گذاری هوشمند، حاکمیت مسئولانه فناوری و حفظ ارزش‌های بنیادین حقوقی مانند انصاف، برابری و دادرسی عادلانه است. /downloadfilepdf/62249
